Regulatory Analysis

We offer economic analysis to determine fair market value (FMV) of tangible and intangible assets for various regulatory and compliance contexts. FMV is generally considered to be the price at which the asset would change hands between a willing buyer and a willing seller, neither being under any compulsion to buy or to sell and both having reasonable knowledge of relevant facts.

We evaluate FMV relating to the Real Estate Settlement Procedures Act (“RESPA”), which regulates the fees that can be charged for those leads.  Our analysis of FMV can assist in evaluating whether fees are reasonable and within RESPA guidelines.

We provide analysis and reports to demonstrate that prices charged by one affiliate to another, in an intercompany transaction involving the transfer of goods, services, or intangibles, yield results that are consistent with the results that would have been realized if uncontrolled taxpayers had engaged in the same transaction under the same circumstances.

In addition to proactive analysis, we also provide after-the-fact analysis to evaluate whether transactions, pricing, and other economic factors are reasonable for the purposes of dispute resolution.
