Dr. Matt Farber provided expert testimony in a patent infringement action involving LED-illuminated LCD display technology used in computer monitors and related products. Retained on behalf of SVV Technology Innovations, Dr. Farber and his team developed the damages case, analyzed licensing and financial evidence, and presented expert testimony at trial. The case involved multiple asserted patents covering optical and light-management technologies and proceeded to a jury trial in the U.S. District Court for the Western District of Texas.
Valuing a large patent portfolio across consumer electronics products
The matter required valuation of a large portfolio of asserted patents across numerous accused products and product generations sold over an extended damages period. Dr. Farber’s team developed a damages framework that evaluated comparable patent licenses, analyzed extensive product‑level sales and cost data, and assessed the economic benefits associated with the accused technology. The case presented complex issues of apportionment, licensing comparability, and valuation of technological contributions within consumer electronics products. Dr. Farber translated these issues into a clear and reliable damages model suitable for presentation to the jury.
Jury awards $22.4 million in patent damages after four-day trial
After a four-day jury trial, the jury found infringement of all asserted claims and awarded the plaintiff $22.4 million in damages. Dr. Farber’s damages opinions survived Daubert scrutiny, were presented to the jury at trial, and were later upheld in post-trial proceedings. In denying ASUSTeK’s challenges to the damages award, the Court found that “the jury’s damages verdict is supported by substantial evidence” and concluded that the jury had “weighed all the evidence in reaching its unanimous verdict.” Following trial, the Court denied ASUSTeK’s requests for judgment as a matter of law and a new trial, granted enhanced damages, and awarded supplemental damages and ongoing royalty relief. The matter demonstrates the ability of Dr. Farber and his team to develop, defend, and successfully present sophisticated patent damages analyses in high-stakes technology litigation involving major consumer electronics manufacturers.
