Scott Elmshaeuser has consulted on a variety of intellectual property and antitrust matters spanning a range of industries, including pharmaceuticals, biotechnology, consumer electronics, and medical technology. His work encompasses patent infringement, trade secret misappropriation, price discrimination, and price-fixing disputes.
The following are examples of Mr. Elmshaeuser’s consulting work:
- Evaluation of price-fixing allegations relating to alleged conspiracy in the pharmaceutical industry.
- Assessment of lost profits and reasonable royalty damages for patent infringement relating to genomics products and personal computers.
- Evaluation of damages in connection with trade secret misappropriation and breach of contract claims in the pharmaceutical and freight forwarding industries.
- Rebuttal of a conjoint survey analysis and assessment of demand drivers and willingness-to-pay for patented consumer electronics.
- Analysis of price discrimination across multiple states related to the distribution of wine and spirits, and the resulting competitive harm to independent alcohol retailers.
- Rebuttal of motions for preliminary injunctions and temporary restraining orders, including the evaluation of irreparable harm, balance of hardships, public interest, and bond analyses in matters involving generic drugs and biosimilars.
- Analysis of the economic factors relating to a potential temporary exclusion order for medical devices.
Prior to joining Insight Economics, Mr. Elmshaeuser completed an internship with the Actuarial Department of the North Carolina Department of Insurance. In this role he provided analysis for the Personal Passenger Auto and Dwelling Rate Filings and conducted Medicare refund calculations. Mr. Elmshaeuser attended Wake Forest University where he conducted economic research for and competed in the National College Fed Challenge, advancing with his team to the national semifinals.
Mr. Elmshaeuser co-authored the paper Artificial Intelligence-Based Analytics for Impacts of COVID-19 and Online Learning on College Students’ Mental Health, which was published in the PLOS One peer-reviewed journal.
Scott Elmshaeuser received a Bachelor of Science in Mathematical Economics with minors in Sociology and Statistics from Wake Forest University, from which he graduated cum laude.
In his free time, he enjoys playing tennis, reading, camping, and kayaking.
